General terms and conditions


1. General provisions

These general business conditions regulate the rights and obligations of the contracting parties arising from the purchase contract concluded between the seller and the buyer, the subject of which is the purchase and sale of goods on the website www.aerialfitshop.com. Seller and operator means Aerial Fit Shop, Ing. Tomáš Šimko, Landererova 7743/8, 81109 Bratislava - Staré Mesto, Slovakia, IČO: 51619784, DIČ: 1082296325, Not a VAT payer. Registered in the Trade Register of the Bratislava District Office, no. 110-293701. The buyer is the customer who on the basis of submitting the order enters into a contractual relationship with the seller.

2. Prices

The selling price of the goods valid for the customer is stated for each product. After selecting another size or color, the price is updated immediately. This price is final and includes VAT. The price of the goods does not include transport. Discounts on sales prices cannot be combined with each other.


3. Order 
To order the goods, put it in the shopping cart. You can then decide whether you want to continue shopping or finish your purchase. The order is made by clicking on the button marked "Complete the order with the obligation to pay". By sending the order, the customer agrees that the order includes the obligation to pay the price. Without undue delay after processing the order, we will send you a confirmation of receipt of the order, which contains the order number, name and specification of the goods, information about the price of the goods, method of payment, method of delivery and its price, information about the expected delivery time. about the seller, or other information. Delivery of the confirmation e-mail about the receipt of your order concludes the purchase contract. You can find all your orders in the My Account section under the Orders tab.


4. Order cancellation

If you wish to cancel an order that has not yet been processed, please contact us as soon as possible by e-mail or telephone and provide the order number. If the payment for the order has already been paid, the money will be returned to you within 14 days to the account specified by you.

At the same time, we reserve the right to cancel your order for goods if we are no longer able to deliver it to you due to its sale or at the price listed in the online store, unless we agree with you on a replacement. We will immediately inform you about the cancellation of the order by phone or e-mail. In the event of payment of the purchase price or part thereof, the funds will be returned to you within 14 days to the account from which you paid, unless we agree otherwise.


5. Delivery times

Delivery time is a maximum of 30 days from receipt of the order.

If we have the ordered goods in stock, we will send them no later than the next working day after receiving the order. Otherwise, we will inform you immediately about the estimated replacement date of delivery of goods. When ordering before 15:00, we usually send the goods on the same day.


6. Method of delivery of goods and price for transport

Unless otherwise specified, we send the goods within Slovakia by courier or via Slovenská pošta. Shipments are usually delivered the next working day after dispatch. Prices and delivery options are described in detail on the page delivery and payment.


7. Method of payment

Possible payment methods are:

- bank transfer (payment by bank transfer to our account)

- card payment online


8. Warranty

The warranty period is set at a minimum of 24 months and runs from the date of receipt of the goods by the buyer. It does not cover damage due to improper handling of the goods by the buyer. The seller is responsible for defects in the goods or services until taken over by the buyer.

The seller is liable to the customer for:

- delivery of goods so that they are not damaged

- delivery of goods in the quantity and assortment in which it was specified in the order

- delivery of a tax document, unless the customer has requested otherwise


9. Alternative dispute resolution

If you are not satisfied with the processing of your order, delivered goods or our services, send us a complaint by e-mail to info[at]aerialfitshop[dot]sk. If you are not satisfied with the way your complaint is handled or if you believe that we may have violated your rights, you may submit a proposal for the initiation of ADR of the ADR entity. You can submit the proposal in the manner specified pursuant to §12 of Act 391/2015 Coll. The list of ADR entities can be found on the website of the Ministry of Economy of the Slovak Republic www.mhsr.sk.

Alternative dispute resolution can be used only by the consumer - a natural person who does not act within the subject of his business activity, employment or profession when concluding and fulfilling a consumer contract. Alternative dispute resolution only concerns a dispute between a consumer and a seller arising out of or in connection with a consumer contract. Alternative dispute resolution only applies to distance contracts. Alternative dispute resolution does not apply to disputes where the value of the dispute does not exceed EUR 20. The ADR entity may require the consumer to pay a fee for initiating an alternative dispute resolution up to a maximum of EUR 5 with VAT.

10. The customer's right to return the goods - withdrawal from the contract

The goods that you have purchased on www.aerialfitshop.com can be returned without giving a reason within 14 working days of receiving the goods in accordance with Art. § 7 of Act no. 102/2014 Coll. It is possible to withdraw from the contract only in a verifiable manner in writing (in paper form or in the form of a record on another durable medium (e-mail)). You can withdraw from the contract using a form available on our website. To download the form, right-click on the link and select "Save File". The period for withdrawal from the contract is considered to have been observed if you sent the notice of withdrawal from the contract no later than on the last day of the period.

The consumer cannot withdraw from the contract if it is for the sale of goods made to the specific requirements of the consumer, custom-made goods or goods designed specifically for one consumer.

The goods to which the withdrawal applies must be sent to the address of the operator no later than 14 days after the withdrawal from the contract. Please do not send us cash on delivery. The costs associated with the return of goods are borne by the customer.

We will refund the purchase price of the goods to the account you specified within 14 days at the latest, unless we agree otherwise (for example, a purchase voucher). Upon withdrawal from the contract, the cost of delivery of goods will also be refunded in the value of the cheapest common method of delivery. In case of unauthorized withdrawal from the contract, the goods will be returned to you at your expense. Withdrawal from the contract terminates the purchase contract from the beginning.


11. Complaints procedure

Incomplete shipment or damage to the goods must be reported within 24 hours of receipt of the shipment by e-mail or telephone. Subsequent claims for incomplete shipment or mechanical damage to the product may not be accepted.

If you want to complain about the purchased goods, please contact us in advance. Please send us the claimed goods (preferably only after agreement with us) for review. We recommend that you send the goods as a package by registered mail. Please do not send the goods to us by cash on delivery.

After receiving the claimed goods, we will contact you immediately by e-mail or telephone and we will agree with you on a quick solution to the problem. After acknowledging the complaint, according to your decision, we will exchange the claimed goods piece by piece, or provide another one that you choose (up to the value of the claimed goods). We bear the costs of delivery of new goods. If the complaint is accepted, you also have the right to withdraw from the contract and in that case we will refund your money. The complaint will be settled as soon as possible, but no later than 30 days from receipt of the complaint. You will be informed about the result of the complaint immediately after the end of the complaint procedure by e-mail and a complaint protocol will be delivered together with the goods.

13. Protection of personal data

In order to process the order, it is necessary to process information about the buyer, which has the character of personal data in accordance with Act no. 18/2018 Coll., On personal data protection. These general terms and conditions are an integral part of the purchase contract concluded between the seller and the buyer. They are binding on both parties. Legal relations established by the purchase contract will be governed by the provisions of the purchase contract (ie the binding order and order confirmation, or individually agreed conditions), the provisions of these general terms and conditions and the relevant legal regulations. The provisions of the purchase contract take precedence over the provisions of these general terms and conditions and the dispositive provisions of generally binding legal regulations. The seller reserves the right to unilaterally change or supplement these general terms and conditions. Any changes to these general terms and conditions take effect on the day of their publication on the website www.aerialfitshop.com. Legal relations arising from the purchase contract are always governed by the general terms and conditions in effect at the time of the binding order of goods.
